¿ES EL PUEBLO SOBERANO?
Si no amas al prójimo que ves, no
amarás a Dios al que no ves, así dice la biblia, en palabras de Jesús.
Frases como: El pueblo es soberano.
Pierden su razón de ser. Quizás en algún tiempo o en algún lugar de un gran
país, como decía la letra de una popular canción, esto pudiese ser así, pero no
en la Europa de hoy, ¿cómo va a ser soberano un pueblo, si no es el que elige a
su máximo dirigente? ¿cómo es soberano un pueblo, si, aunque vote a un
determinado partido de forma mayoritaria luego la lista más votada no es la
que rige sus designios? ¿cómo es soberano un pueblo si solo tiene el arma del
voto para designar un partido, pero carece de mecanismos para poder apartarlo
del poder? ¿cómo es soberano el pueblo, si por muy clara que tenga su
constitución la interpretación de esta, está en manos de un minúsculo grupo de
personas, que a veces se rinden a unas siglas por intereses partidistas y convicciones
personales?
Un país no podrá ser democrático,
si los miembros que rigen uno de sus pilares fundamentales, el Poder Judicial,
permite que estos miembros estén afiliados a partidos políticos, que a la vez
son los que nombran los puestos principales y que además pueden pasarse al Poder
Político y terminado su tiempo, volver a su puesto en el Poder Judicial. A mi
modo de ver, los Jueces y Fiscales, no deberían estar afiliados a ningún
partido y si pasan a ocupar puestos de Política, no deberían poder retornar a los
puestos en los juzgados, ya que difícilmente podrán ser imparciales en caso de
tener que juzgar a compañeros de partido.
En fin, la diosa romana Justicia se representa
ciega, pero en algunos casos se me antoja que por debajo de la venda que tapa
sus ojos, siempre queda un resquicio de claridad que permite ver quién es, el que
tiene delante.

IS THE PEOPLE SOVEREIGN?

Phrases such as: The people are sovereign. They
lose their reason for being. Perhaps at some time or somewhere in a large
country, as the lyrics of a popular song said, this could be so, but not in
today's Europe, how can a people be sovereign, if it is not the one that elects
its maximum leader? How is a people sovereign, if, even if they vote for a
certain party in a majority way? Then the list with the most votes is not the
one that governs its designs? How is a people sovereign if it only has the weapon
of the vote to designate a party, but lacks mechanisms to remove it from power?
How is the people sovereign, if no matter how clear its interpretation is, it
is in the hands of a tiny group of people, who sometimes surrender to an
acronym for partisan interests and personal convictions?
A country cannot be democratic if the members
who govern one of its fundamental pillars, the Judiciary, allow these members
to be affiliated with political parties, which at the same time are the ones
who appoint the main positions and who can also move to the Political Power and
after their time, return to their position in the Judicial Branch. In my view,
Judges and Prosecutors should not be affiliated with any party and if they go
on to occupy positions in Politics, they should not be able to return to positions
in the courts, since they will hardly be able to be impartial in the event of
having to judge party colleagues.
In short, justice is represented blindly, but
in some cases it seems to me that under the blindfold that covers his eyes,
there is always a glimmer of clarity that allows us to see who it is, the one
in front of him.
